Terms of services between Studio Artwise.in and it's Digital Visiting Card Subscribers-

The Terms & Conditions as per the ‘Agreement’ below are an integral part of the website and our Company, ‘Studio Artwise.in’. Please read the Terms & Conditions carefully opting for our service of “Digital Visiting Cards’, hereinafter to be known as DVC in this Agreement.

The acceptance of terms of services related to DVC is a pre-requisite for availing our DVC services through our website. If you are not willing to accept the terms, you may please exit to avail our services of DVC. Our company, ‘Studio Artwise Business Solutions Private Limited, reserves the right to modify/delete/revise any of the Terms from time to time as per our internal policies and business requirements. The DVC registered users shall be advised by email whenever there is a modification/deletion/revision in any of our Terms and conditions for the DVC registered users, your acceptance of the revised policy shall be a pre-requisite to continue to avail our DVC services.

1. DEFINITIONS

1.1. ‘Agreement’ herein means, the Agreement with acceptance of Terms & Conditions between our website and the registered users.

1.2. ‘Digital Visiting Card’ users means, the registered user who has paid for availing our digital visiting card and has created the digital visiting card by providing information as required for the card.

1.3. ‘Effective date’ means, the date of acceptance of this Agreement and making payment for DVC services.

1.4. In case the date of acceptance of this Agreement and the date of payment differs, the effective date shall be the date of payment received by the service provider i.e., Studioartwise.in.

1.5. ‘Payment Gateway’, means the online payment service provider listed on our website for processing payment.

2. ELIGIBILITY TO REGISTER ON OUR PLATFORM

2.1. Prior to registration on our platform please confirm you are above 18 years of age and have attended the majority.

3. PLATFORM

3.1 The platform herein means our website ‘www.studioartwise.in’.

3.2 Studioartwise.in is offering its services in 3 different areas which are Digital Visiting Cards, template-based static websites, and template-based e-commerce websites.

3.2 The users signing up for Digital Visiting Cards are required to abide by the terms of services related to Digital Visiting Cards.

3.3. The users signing up for the website for DVC are doing so willingly and have the option of not signing up in case the terms of services are not suitable for them.

3.4 The website is a platform for its users to create a digital visiting card, which will be in virtual format. The same shall be shareable to multiple users with the use of a scan code, hyperlink, or pdf format.

3.5 The platform acts merely as an intermediary between the registered users and their users or connects. The platform does not own any rights to the registered user’s information, contact details, and revenue so generated from the commercial use of the DVC (Digital Visiting Card).

3.6 The platform does not have any responsibility for the safeguard of DVC which is shared by the registered users with their customers, friends, and any other individual or organization. The safeguarding of the DVC solely relies upon the hands of the DVC registered user.

3.7 The platform also does not hold any connection between the DVC’s registered users and their further users or with whom they are sharing their DVC. It is the responsibility of the DVC holder to share the DVC with people of their trust and choice.

3.8 In whatsoever manner, the platform is not involved in the verification of actual address, business, profession, or verification of the information shared by the registered user except for the phone number and email address which is mandatory for verification of the profile.

3.9 The platform is offering a virtual space for DVC users to create their Digital cards for a minimal fee. It does not have control over further misuse, data theft, spamming, or any unauthorized usage by any third party.

3.10 The platform offers a space to the users in lieu of a registration fee. The platform is not responsible for profile mismanagement/data theft or any unauthorized usage by any third-party vendor/production house or any other third party.

3.11 The platform is not engaged in any advisory/counseling services to any DVC users in whatever manner.

4. DIGITAL VISITING CARD USER TERMS

3.1 The DVC services can be availed by individuals, professionals, proprietary concerns, partnership concerns, companies, or any other person who is willing to create and is legally allowed to create a Digital Visiting Card.

3.2 The users intending to create a DVC are entitled to provide accurate information like Name, business or profession, contact number, and email address to studioartwise.in. The phone number and email address shall be verified by the team of studioartwise.in.

3.3 Studioartwise.in reserves the right to accept or reject the user’s DVC creation request at its own discretion. The DVC creation can be rejected on various grounds including reasons which are beyond communication.

3.4 The platform is not obliged to communicate the exact reason for the rejection of DVC creation; however, the rejection shall be communicated.

3.5 The creation of DVC is chargeable at a minimum fee of Rs.500 as a yearly payment for a single card. In Rs.500 the basic DVC with standard features which are disclosed in our product description box on the website. If the users sought any customization in terms of information, design, etc., the same shall be chargeable on a case-to-case basis.

3.6 The users' contact information is subject to verification by the platform by sending a confirmation email and confirmation SMS as and when required. The contact information shall be for a record of the platform and shall not be shared with any third party without the prior consent of the user.

3.6 DVC users are restricted from sharing their user id, password, and DVC creation details with any third party. The registration details are limited to the uses of the user creating the account and creating the DVC.

3.7 The registered users are mandatorily required to abide by all the Terms and Conditions of this Agreement and agree to upload factual, valid, appropriate, non-abusive, non-sexual, non-violent original information in their DVC.

3.8 The platform reserves the right to scrutinize the information provided for the creation of the card and approval or rejection shall be communicated within 48 hours after uploading of information.

3.9 The registered users are strictly advised to upload contact information, address, and business profile of their own. Misleading and wrong information shall call for criminal complaint against the user.

3.10 This agreement and the fee of DVC are valid for a period of 1 year from the date of the agreement.

5. ACCEPTANCE OF THE TERMS AND CONDITIONS

IT IS MANDATORY FOR THE USERS TO READ AND UNDERSTAND THE TERMS AND CONDITIONS OF THIS AGREEMENT IN FULL. IF THE USERS HAVE ANY DOUBTS OR USERS SEEKING FOR CLARIFICATION ON ANY OF THE CLAUSES MENTIONED ABOVE ARE REQUESED TO SEND AN EMAIL TO MAIL@STUDIOARTWISE.IN BEFORE OPTING FOR REGISTRATION AND BEFORE PAYMENT OF REGISTRATION FEE.

3. PLATFORM

3.2 Studioartwise.in is offering its services in 3 different areas which are Digital Visiting Cards, template-based dynamic website, and a template-based e-commerce website.

3.2 The users signing up for any of the services are required to accept the terms & conditions of the platform for the specific service.

3.3. The users signing up for the website for dynamic websites are doing so willingly and have the option of not signing up in case the terms of services are not suitable for them.

3.4 The website is a platform for its users to create a dynamic website using the available templates. The users registering on the website for building a dynamic website shall be selecting one of the templates available on the platform.

3.5 The platform is not responsible for further sharing of the website URL or business information by the registered users. The registered user is solely liable for the sharing, promoting, and using of the payment gateway and any other acts being done after the creation of the dynamic website through the platform.

3.6 In whatsoever manner, the platform is not involved in the verification of actual address, business, profession, or verification of the information shared by the registered user except for the phone number and email address which is mandatory for verification of registration on the platform.

3.9 The platform is offering a template to create a dynamic website for their registered users of the dynamic website for a minimal fee. It does not have control over further misuse, data theft, spamming or any unauthorized usage by any third party.

3.10 The platform offers a template for the creation of a dynamic website to the users in lieu of a registration fee. The platform is not responsible for profile mismanagement/data theft or any unauthorized usage by any third-party vendor/production house or any other third party.

3.11 The platform is not engaged in any advisory/counseling services to any dynamic website users in whatever manner.

4. DYNAMIC WEBSITE USER TERMS

4.1 The template-based dynamic website builder services can be availed by individuals, professionals, proprietary concerns, partnership concerns, companies, or any other person who is willing to create and is legally allowed to create a dynamic website.

4.2 The intended users are required to create a profile on the platform by providing their presently in-use mobile number and email id. The website will validate the basic contact details for registration.

4.3 Studioartwise.in reserves the right to accept or reject the user’s request for the creation of a profile on the platform, the rejection or acceptance shall be communicated. However, the platform reserves the right to not communicate the grounds of rejection.

4.4 The creation of a template-based dynamic website is chargeable at a minimum fee of Rs.2,000 as a yearly payment for one website. At Rs.2,000 the basic dynamic website with standard features will be available for creation. The standard features related to dynamic websites are disclosed in our product description box on the website. If the users sought any customization in terms of information, design etc., the same shall be chargeable on a case-to-case basis.

4.6 The service of dynamic website builder does not include the service of domain name registration. The users are requested to register the domain name as per their requirement on domain name provider websites.

4.7 The dynamic website builder service shall be activated once the user provides the domain name which he/she has registered and makes the full payment of Rs.2,000 for proceeding ahead with the website creation on our platform.

4.8 There shall be no facility for part payments on our platform. Also, the users are requested to go through all the standard features available with the dynamic website creation feature. If the user requires any additional features, he shall communicate with the team at mail@studioartwise.in before proceeding ahead with the payment process.

4.9 The users upon getting written confirmation about the availability of customized features as per their requirement with the platform, shall proceed ahead with the payment process. The platform shall not be responsible for the non-availability of any feature if prior written confirmation is not obtained by the user.

4.10 Dynamic website users are restricted from sharing their user id, password, and website creation details with any third party. The registration details are limited to the uses of the user creating the account and creating the dynamic website.

4.11 The registered users are mandatorily required to abide by all the Terms and Conditions of this Agreement and agree to upload factual, valid, appropriate, non-abusive, non-sexual, non-violent original information on their dynamic website.

4.12 The platform reserves the right to scrutinize the information provided for the creation of the website and approval or rejection shall be communicated within 48 hours after uploading of information.

4.13 The registered users are strictly advised to upload contact information, address, and business profile of their own. Misleading and wrong information shall call for criminal complaint against the user.

4.14 The platform reserves the right the delete the website created or cancel publication of the website if the website contains any abusive, anti-religious, sexual, violative, or any content which can create disharmony in the public or any specific religious segment. The website content shall not contain which is unconstitutional, violative, sexually abusive, instigating religious sentiments and spreading violence, disharmony, and affecting the peace of the public and regions of any country.

4.15 This agreement and the fees of dynamic website builder is valid for a period of 1 year from the date of the agreement.

5. ACCEPTANCE OF THE TERMS AND CONDITIONS

IT IS MANDATORY FOR THE USERS TO READ AND UNDERSTAND THE TERMS AND CONDITIONS OF THIS AGREEMENT IN FULL. IF THE USERS HAVE ANY DOUBTS OR USERS SEEKING FOR CLARIFICATION ON ANY OF THE CLAUSES MENTIONED ABOVE ARE REQUESTED TO SEND AN EMAIL TO MAIL@STUDIOARTWISE.IN BEFORE OPTING FOR REGISTRATION AND BEFORE PAYING OF REGISTRATION FEE.

3.9 The platform reserves the right to delete/remove profiles of any users in case the e-comm website seems to be inappropriate for listing on the website after due notice. The platform reserves the right to delete/remove e-comm websites which are reported not appropriate, abusive, political, violent by any other user/Business user.

3.9 The platform is not engaged into any advisory/counselling services to any e-comm website users in whatever manner.

4. E-COMMERCE WEBSITE USER TERMS

4.1 The template-based e-comm website builder services can be availed by individuals, professionals, proprietary concerns, partnership concerns, companies or any other person who is willing to create and is legally allowed to create an e-comm website.

4.2 The intended users are required to create a profile on the platform by providing presently in-use mobile number and email id. The platform will validate the basic contact details for registration.

4.4 The creation of a template-based e-comm website is chargeable at a minimum fee of Rs.10,000 as a yearly payment for one website. At Rs.10,000 the basic e-comm website with standard features will be available for creation. The standard features related to e-comm websites are disclosed in our product description box on the website. If the users sought any customization in terms of content, design, marketplace, payment gateways etc., the same shall be chargeable on a case-to-case basis.

4.5 The service of e-comm website builder does not include the service of domain name registration. The users are requested to register the domain name as per their requirement on domain name provider websites.

4.6 The e-comm website builder service shall be activated once the user provides the domain name which he/she has registered and makes the full payment of Rs.10,000 for proceeding ahead with the website creation on our platform.

4.7 There shall be no facility for part payments on our platform. Also, the users are requested to go through all the standard features available with the dynamic website creation feature. If the user requires any additional features, he shall communicate with the team at mail@studioartwise.in before proceeding ahead with the payment process.

4.8 The users upon getting written confirmation about the availability of customized features as per their requirement with the platform, shall proceed ahead with the payment process. The platform shall not be responsible for the non-availability of any feature if prior written confirmation is not obtained by the user.

4.9 E-comm website users are restricted from sharing their user id, password, and website creation details with any third party. The registration details are limited to the uses of the user creating the account and creating the e-comm website.

4.10 The user is required to create their own marketplace for buying/selling goods or services through his E-comm website created on www.studioartwise.in.

4.11 www.studioartwise.in does not provide a marketplace for buying/selling goods or services of its registered users. It merely provides templates and hosting services for the creation of e-comm websites.

4.12 The users are thereby advised to create their own marketplace, post products/services, manage profiles of their users, manage database and additional data space if required, and overall manage and maintain the entire e-commerce website on their own.

4.13 The registered users who shall be availing the services of our templates and hosting services for the creation of the e-comm website should be involved in buying/selling of legally allowed goods or services as per Indian Laws. The users are mandatorily required to refrain from buying/selling goods and or services which are banned from buying/selling in India and other countries.

4.14 The users if found to be involved in buying/selling any goods or services which are legally banned shall be reported to the respective reporting department of Govt of India. The users can refer to the list of banned goods/services from the Department of Commerce website of the Government of India.

4.15 The users are also requested to abide by all the e-commerce policies of the Government of India. Any user found violative of the policies of the Government shall be subject to reporting to the Government as well the websites shall be unpublished/removed till further notification from the Government.

4.16 The platform reserves the right to scrutinize the information provided for the creation of the website and approval or rejection shall be communicated within 48 hours after uploading of information.

4.17 The registered users are mandatorily required to abide by all the Terms and Conditions of this Agreement and agree to upload factual, valid, appropriate, non-abusive, non-sexual, non-violent original information on their e-comm website.

4.18 The registered users are strictly advised to upload contact information, address, and business profile of their own. Misleading and wrong information shall call for criminal complaint against the user.

4.19 The platform reserves the right the delete the website created or cancel publication of the website if the website contains any abusive, anti-religious, sexual, violative, or any content which can create disharmony in the public or any specific religious segment. The website content shall not contain which is unconstitutional, violative, sexually abusive, instigating religious sentiments and spreading violence, disharmony, and affecting the peace of the public and regions of any country.

4.20 The registered users shall be assigned a profile id and a user dashboard which will be accessible by their login id and password. The dashboard shall be accessible to the user strictly and users are requested not to share their login password to any other third party.

Terms and Conditions

Payment gateway terms between Studio Artwise.in and its Template based E-commerce website users-

(Please note the e-commerce website user will have to enter into a separate agreement with their payment gateway provider. The below terms of payment gateway provider are just preliminary to clear your viewpoint. You may or may not share this with the users)

Payment Gateway user terms

1. The users availing our template-based e-commerce website builder services are advised to enter into separate agreements with their payment gateway providers. The payment gateway providers on our platform are specifically meant for our platform and they are not entitled to provide services to users of our platform.

2 The e-commerce website users who are offering buying/selling of products through online marketplace on their website which will be hosted on our website will be required to install payment gateway security certifications and other security features on their website on their own.

3 Studioartwise.in does not provide services of payment gateways to any of its users. Neither do we provide security certification or features thereto.

4 If the e-commerce website registered user fails to comply with Government regulations for e-commerce websites or fails to comply with rules of the payment gateway our platform shall not be liable for the same.
